【摘要】根据证据学的观点提出法医鉴定结论是一种科学证据，指出无论是民事诉讼还是刑事诉讼中，对其
进行质证对维护司法公正的必要性和重要性。由于法医鉴定结论的专业性，对其质证时，当事或控辩双方，以及法院
聘请法医专家顾问。协助对法医鉴定结论的质证具有重要的意义。

【abstract】 d on the science of evidence，this paper points out that the conclusion of forensic medicine is a
science evidence d on the viewpoint of studies of evidence and that its questioning is necessary and important
whether in civil action or in criminal tria1． due to the professional nature of forensic conclusion， it is important to both
sides of the charge and dispute as well as to the court retaining an expert adviser of forensic medicine who helps the

、法医鉴定结论是一种科学证据。必须经过质证
按照我国刑事诉讼法、民事诉讼法和行政诉讼
法对诉讼证据的规定。“证明案件真实情况的一切事
实，都是证据”，并把证据分为7种：①物证、书证；②
证人证言；③被害人陈述；④犯罪嫌疑人、被告人供
述和辩解；⑤ 鉴定结论；⑥勘验、检验笔录；⑦视听资
料。鉴定结论由于是鉴定人运用专门的科学技术对
客观事物检验，并运用科学理论对检验结果加以分

析判断后得出的结果，因此有人将其称为科学证据
(science evidence)．以示与其他六种普通证据(com—
men evidence)一般为当事人或证人所直接感知(看
见或听见)的事实的区别。随着科学技术的进步，犯
罪涉及的科学技术会越来越多，需要鉴定结论的科
学证据也会越来越多。它们在涉及科学技术犯罪的
证据认定上的作用，也将越来越重要。
