【摘要】随着科学技术发展，人体植入物和移植物的应用越来越广泛，人体植入物、移植物损害案件的报道也渐增多，
与此同时必然会引起法律上身体概念的内涵变化和相关法医学鉴定等问题争议。本文对法律上身体的内涵和人体植入物、
移植物损害后人体损伤程度鉴定原则予以讨论。

随着现代医学进步和人们生活水平的提高。人们
更注重生活的质量，并通过各类移植或整形手术、康复
治疗来改善体形、容貌或生理功能，因此人体植入物、
移植物应用也越来越广泛，人体植入物、移植物损害
案件报道日趋增多，但人体植入物和移植物损害的法
律属性有时还存在分歧，是侵犯他人健康权的人身损
害还是财产损失，目前学者们认识逐渐明晰 当植入
物、移植物已完全融人人体密不可分，并替代相应的
功能或体现相应的形貌时，从身体概念考虑可视为人
体原有器官、组织或其部分，但法律和相应标准尚无
明确规定。为此本文对相关理论问题和鉴定原则进行
探讨。

、移植物、植入物的概念和人体植入、移植的发
展概况
移植(transplantation)是将身体的某部分(如细胞、
组织或器官)通过手术或其他途径移到同一个体或另
一个体的特定部位，而使其继续生活的方法。被移植
的部分称为移植物(transplant)。在移植医学中，移植
物不包括人工合成的高分子生物材料和各种金属材
料在体内的应用，如人工皮肤、人工心脏瓣、镶牙、种
植牙、各种人工关节及假肢。在生物医学工程学，这些
人工合成的高分子生物材料和各种金属材料属于植
